DREAMMIRROR TERMS OF SERVICE

1. Scope and Acceptance

These Terms apply to individuals who access or use DreamMirror for personal, non-commercial purposes. If you are using DreamMirror on behalf of a business or other legal entity, different terms may apply, and you should refer to the business terms of service.

2. Definitions

• "DreamMirror" means New Port's web-based AI application and related services that enable virtual try-on, styling, image generation, video generation, transformation, or related functionality.
• "User" means an individual who accesses or uses DreamMirror.
• "Input" means any image, video, prompt, parameter, file, text, metadata, or other material submitted, uploaded, captured, or provided by User to DreamMirror.
• "Output" or "Generated Output" means any image, video, styling result, transformation, recommendation, generated content, or other result created by DreamMirror from Input.
• "User Data" means all data, content, files, images, videos, prompts, Inputs, Outputs, Generated Outputs, session data, metadata, personal data, and other materials submitted to, processed by, generated through, or made available in DreamMirror by User.

3. User Accounts

To use certain features of DreamMirror, you may need to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify New Port of any unauthorized use of your account or any other breach of security.

4. User Responsibilities

• You will use DreamMirror only for lawful personal purposes and in accordance with these Terms.
• You will not upload or submit content that infringes any intellectual property rights, privacy rights, or other rights of any person.
• You will obtain the consent of any person whose image or likeness is included in your Input, and you will not submit images or videos of minors without appropriate consent.
• You will not submit or permit the submission of sensitive personal data, including payment card data, government identifiers, or protected health information, unless expressly permitted by New Port.
• You will not misuse DreamMirror, including by attempting to access it using automated tools, introducing malware, or bypassing security measures.

5. Privacy and Data Processing

New Port will process User Data solely as necessary to provide, operate, secure, maintain, troubleshoot, and support DreamMirror and as otherwise expressly authorized by you. New Port will not sell, rent, lease, trade, or otherwise monetize User Data, and will not use User Data for AI model training, fine-tuning, research, development, benchmarking, advertising, marketing, or other secondary use without your explicit consent.

6. Data Retention and Deletion

User Data will be retained only for as long as necessary to provide the DreamMirror services or as otherwise permitted by you. Images, videos, and Generated Outputs may be deleted after the session ends unless you choose to save or download them. You may request deletion of your User Data by contacting New Port.

7. Security

New Port employs commercially reasonable security measures to protect User Data from unauthorized access, disclosure, alteration, or destruction. However, no security system is perfect, and you use DreamMirror at your own risk.

8. Ownership and Intellectual Property

As between you and New Port, you retain all rights you have in your User Data. New Port retains all rights, title, and interest in and to DreamMirror, including its software, models, algorithms, user interfaces, workflows, documentation, and other technology. DreamMirror uses generative AI, and similar or identical outputs may be generated for different users. New Port does not guarantee that Generated Outputs will be unique, original, non-infringing, or suitable for your intended use.

9. Disclaimer of Warranties

DreamMirror is provided on an "as available" basis. While New Port strives to maintain reliable and secure services, New Port does not guarantee uninterrupted availability, error-free operation, uniqueness, originality, non-infringement, or the suitability of Generated Outputs for any particular purpose. You use DreamMirror at your own risk.

10. Limitation of Liability

To the maximum extent permitted by law, New Port will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost goodwill, or business interruption, even if advised of the possibility of such damages. New Port's total aggregate liability arising out of or relating to these Terms will not exceed US$10,000 or the amount you paid (if any) for use of DreamMirror during the twelve (12) months preceding the event giving rise to the liability, whichever is greater.

11. Indemnification

You agree to indemnify and hold harmless New Port and its affiliates, officers, directors, employees, contractors, and agents from and against any third‑party claims, damages, liabilities, costs, and expenses, including reasonable attorneys' fees, arising from your misuse of DreamMirror or violation of these Terms.

12. Termination

New Port may suspend or terminate your access to DreamMirror if New Port reasonably determines that suspension or termination is necessary to prevent a security risk, legal violation, misuse, harm to individuals, or breach of these Terms. You may stop using DreamMirror at any time. Sections that by their nature should survive will survive termination.

13. Governing Law and Dispute Resolution

These Terms will be governed by the laws of the State of Illinois, without regard to conflict-of-law rules. Any disputes arising out of or relating to these Terms will be subject to the exclusive jurisdiction of the courts located in Cook County, Illinois, or the federal courts located in the Northern District of Illinois.

14. Miscellaneous

These Terms constitute the entire agreement between you and New Port regarding your use of DreamMirror and supersede any prior agreements regarding the same subject matter. If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in effect. New Port may modify these Terms at any time by posting the revised Terms, and your continued use of DreamMirror after such posting constitutes your acceptance of the revised Terms.
